Republican Congressman Mike Kelly is leading a lawsuit that asks courts to declare mail-in ballots unconstitutional.
Kelly, who represents a portion of Butler as part of the 16th Congressional District, argues in the suit that the 2019 state law that passed was “illegally implemented.”
He is asking the Commonwealth Court of Pennsylvania to bar the state from certifying any election result that includes mail-in ballots.
Around 2.6 million voters cast a ballot by mail in this past election.
Kelly was joined by Congressional candidate Sean Parnell in the lawsuit.
