A lawsuit filed by a former student against the Butler Area School District has been dismissed.
Robert Wellman Jr filed the suit in United States Court of Appeals after he suffered a concussion while playing flag football in physical education class in 2009.
Wellman alleged that the district’s indifference to his need for accommodations while healing resulted in increased stress and additional problems. Wellman sustained another head injury during a football game but the suit alleges that the principal was still dismissive.
Wellman eventually moved to a private school and a settlement was reached with the district that included a release for the district and employees. Wellman then filed another lawsuit and the Court of Appeals dismissed that complaint with prejudice due to the fact that all the claims had been released in the previous settlement.
