Former Butler Area School District Board Member Bill Halle was back in court Monday afternoon attempting to have charges against him dismissed.
Two orders have been granted that all records the District Attorney’s office has be given to Halle’s attorney Joel Hills. After not receiving the documents Hills filed a motion to dismiss the case with prejudice.
According to Hills, delays with documents and electronic records (a laptop and Cell phone) have prevented Halle from an opportunity to defend himself.
The district attorney’s office although says it has not had full access to all documents as well. All the documents Hills is seeking is with the Attorney General’s office for a state case being investigated against Halle and electronic records have just been recently given.
Hills has been given the option to travel to Harrisburg to review thousands of documents and make copies. But argued the prosecution would appeal all evidence fillings due to potential chain of custody issues.
The cell phone that was taken as evidence, has just recently been surrendered and Hills says he has just begun to go through the phone.
The laptop although has caused more problems. According to chain of command records the lap top reached the District Attorney’s office. But the office immediately filed a warrant and sent the laptop to a crime lab as the attorney from the Attorney General’s office said the laptop may contain new criminal charges against Halle.
