Two new court filings may delay a trial date even further in the death of 15-year-old Aiden Lutz.
After a rule 600 hearing looking to dismiss all charges against Rivera was held on Tuesday, the District Attorney’s office filed a motion to recuse Judge Christopher St. John after a meeting in the Judge’s chambers.
According to the motion filed by the DA’s office, St. John made bias statements, including not believing this case could be tried as a third-degree murder case. He is also accused of saying, if the defense were to file a judgment of acquittal for the count of murder of the third degree, St. John would grant that motion.
On Monday, the defense filed a motion to recuse the Butler County District Attorney’s office. Saying that a motion to recuse the DA filed two years ago was never settled. That Republican political materials sent out during the 2023 DA election and active litigation for that election the DA is involved in has impacted Rivera’s right to speed and fair trial.
The District Attorney’s Office would not comment on the filing but did say they are proceeding to begin selecting a jury in mid-September.
Joshua Rivera of Butler is accused of hitting and killing Lutz with his vehicle in Butler Township in October 2023.
A hearing date for the newly filed motions has not been scheduled.
