Congressman Mike Kelly is doubling down on his efforts to challenge Pennsylvania election law, arguing that it is unconstitutional.
Kelly penned an op-ed in the Pittsburgh Post-Gazette yesterday saying that he believes Act 77 that implemented election reform in 2019 goes against the state constitution.
Kelly wrote that “legal corners” were cut when Act 77 became law. He believes it’s unconstitutional that mail-in ballots can now be requested without having an excuse.
Kelly also added that Governor Tom Wolf and Secretary of State Kathy Boockvar complicated matters when they implemented changes to this year’s election, although the state officials argue the changes were necessary as a result of the pandemic.
Act 77 passed both the House and Senate in Pennsylvania in 2019 with bipartisan support.
