After a higher court ruling, evidence will be permissible against a man who allegedly hit and killed a 15-year-old in Butler Township nearly three years ago.
The Superior Court made the ruling in the case of 41-year-old Joshua Rivera, who is accused of hitting and killing 15-year-old Aiden Lutz with his vehicle in October 2023 in Butler Township on Dutchtown Road and then driving away.
But, attorneys have filed a rule 600 motion for Rivera that guarantees a defendant’s right to a speedy trial. They argue that delays have been the fault of the prosecution and the 365-day maximum has passed.
The defense filed a similar motion last year that ruled there was 180 days had passed but bail was denied at that time.
If the judge were to rule in favor of the defense, Rivera could be released. A hearing date has not been set.
