
Criminal charges over a cyclist on a major roadway in Butler Township received a ruling from the State Supreme Court yesterday.
The incident happened in 2021 when Brendan Linton was heading west on Evans City Road on a bicycle. After less than 10 minutes on Route 68, Linton was pulled over and fined by a state trooper.
Linton filed appeals all the way to the State Supreme Court and yesterday the court ruled that Linton should not have been fined. Arguing that it was not disorderly conduct for him to have his bike on the roadway.
“Certainly it’s a win for my client, and that’s great. He has put a lot of time and effort into saying he was inappropriately prosecuted for the fact that he was on the road. The Supreme Court states that he is absolutely correct,” Corrie Woods, an appellate counsel for Linton, said.
The ruling made by the Supreme Court sends the decision back to the lower courts and Woods says the decision raises even more questions about roadway safety.
“It’s really hard to know when you need to pull over. I’m concerned about that for cyclists moving forward, and for motorists going forward who don’t know when they need to pass or when they need the cyclist to pullover. So it’s a win for Mr. Linton, but it’s sort of a mixed bag for bicycle safety,” Woods said.
Woods did not say what decision will be taken next.
