An Allegheny County woman has filed a lawsuit against the Zelienople Borough and police department, accusing an officer of excessive use of force.
Police charged then 24-year-old Jaala Bivins of Munhall back in December 2024, for not moving a delivery truck after being warned by officers several times.
She was arrested and placed in the Butler County Prison as she awaited a preliminary hearing.
On December 13th of this year, Bivins filed a suit accusing the officers of an unconstitutional seizure and arrest, excessive use of force, false imprisonment, assault and battery, and emotional distress.
The suit claims officer Michael Kopp did not tell her to move the van and when Bivins offered to move the vehicle, Kopp told her not to move. She says Kopp pulled her out the van leading to her hurting her shoulder.
Charging documents from police at the time of the incident say Bivins was interrupting the flow of traffic.
Bivins is seeking unspecified damages for the 2024 incident.
