State lawmakers are looking to pass legislation that would require judges to consider all criminal history when setting bail.
In September, 46-year-old Dr. Idris Evans, a pediatric critical care physician at UPMC Children’s hospital, was killed inside his home. Police accused and charged 32-year-old Elijah Hemingway in Evan’s death.
According to police, Hemingway broke into the home and attacked Evans and his wife with a kitchen knife. In 2025, a doctor in Florida case ruled Hemingway suffered from a mental illness and found a substantial likelihood he could be a danger to himself or others without treatment. At the time Hemingway was arrested for assaulting a woman and Sheriff deputies before being deemed competent and pleading no contest and receiving time served.
New legislation, currently only sponsored by Republicans, would require the courts to consider all previous criminal records, state, federal, and more before setting bail.
The legislation has not been formally introduced into the state house.
